TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by
that certain Deed of Trust dated March 1, 2022, and duly recorded in the Office
of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed
of Trust Book 3868, at Page 340, Tera M. Martin did convey unto Richard A. Pill,
Trustee, certain real property described in said Deed of Trust; and the
beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a
Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default
having been made under the aforementioned Deed of Trust, and the undersigned
Substitute Trustee having been instructed by the secured party to foreclose
thereunder, will offer for sale at public auction 400 W. Stephen Street, in
Martinsburg, West Virginia, on
May 13, 2025 , at 10:06 AM
The following described real estate, with its improvements, easements and
appurtenances thereunto belonging, situate in the Opequon District, Berkeley
County, West Virginia, and more particularly described as follows:
All that certain real property, with improvements and appurtenances thereunto
belonging, situate, and being, in Opequon District, Berkeley County, West
Virginia, and more particularly described as follows:
BEING all of Lot 31, Phase 1-C, Springfield Village, as more fully shown upon
that certain plat entitled Final Plat of Springfield Village, Phase 1C",
prepared by PHR&A, dated March 17, 1993 and recorded in the Office of the Clerk
of the County Council of Berkeley County, West Virginia in Plat Cabinet 5, at
Slide 80. TOGETHER WITH AND SUBJECT TO any and all recorded easements and
rights-of-way appurtenant thereto for ingress, egress, and utilities, including
but not limited to, those set forth on the aforemention plat.
Property Address: 7 Midnoon Drive, Martinsburg, West Virginia 25404
SUBJECT TO and TOGETHER WITH the following: all covenants, restrictions,
conditions, easements, reservations, rights-of-way, public utility easements,
and other matters of record or in existence, to the extent valid, subsisting,
and enforceable; any lien of taxes for the current year and subsequent years,
accrued but not yet payable; matters that would be shown by an accurate survey
and inspection of the property; zoning requirements, statutes, rules, orders,
restrictions, regulations, and ordinances of governmental agencies or their
instrumentalities relating to the property, the buildings located thereon, their
construction and uses, in force on the date hereof (if any such exist); and, all
roads and legal highways.
At the time of the execution of the Deed of Trust, this property was reported to
have a mailing address of 7 Midnoon Drive, Martinsburg, WV 25404.
AND BEING the same real estate which was conveyed to Tera M. Martin, by Deed
dated March 1, 2022, from Richard Lee Young, and recorded in the Office of the
Clerk of the County Commission of Berkeley County, West Virginia, in Deed Book
1382, at Page 264.
The above-described property will be sold subject to any covenants,
restrictions, easements, leases and conditions of record, and subject to any
unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee
shall be under no duty to cause any existing tenant or person occupying the
subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due
